Down payment in purchasing a home association to finishing basement and attic?
Q. In the process of purchasing a home, specifically a new construction, is it standard for the builder/seller to use the money from the down payment for certain requests made by the buyer (such as finishing the basement and attic)? Isn't it possible that the builder may finish the house, yet fail an insepection, and yet the builder already spent the down payment, therefore making it very difficult to retrieve the down payment?

A. down payment is only to open Escrow. You should of already negotiated the price and condition of transfer. You should also make the purchase contingent upon a home inspection, final walk through etc.. Seems like you can get a better price if you buy the property as is and finish it yourself.

A. I assume that the Association does not own the unit, but is not being paid assessments while the unit is in foreclosure. While State law varies, the Association generally cannot collect directly from the tenant. The Association may be able to get a receiver appointed, depending on the laws of your jurisdiction. A receiver is a person appointed by the court to take possession of the property, and collect any rents, and distribute them according to the Court's order. However, given the legal expenses involved, and the relatively short period of time you would have to collect rents before the foreclosure is completed, it may not be worthwhile.

A. It all depends on your Association. I know they are horrific to work with but you will need their association contracts to find out. When you purchased your condo your Realtor should have provided you with a packet of how the association "rules mighty over it's tenants". It's an entire packet that every buyer gets along with the disclosures during escrow. Hope this points you in the right direction. Good luck.

Becoming part of the credit card processing industry requires major league contacts, insurance binders that have the zeros falling off the edge of the page, more security procedures than you can keep track of and a lot of bucks. A. You will stand in line after the bank. First lien holders get first crack at the receipts from the foreclosure sale and then secondary lien holders such as HOAs. Hoepfully there will be something left over for you.

A. This is something you'd have to take up with a different lawyer. Most attorneys charge a relatively small fee, or none at all, for a consultation visit. It also depends on whose benefit the suit was filed. If it was her estate, then it is liable for all the bills she had pending. If it was a personal suit filed on your behalf, then I wouldn't think it would liable for her medical expenses. Welfare departments frequently claim compensation when a dependent comes into cash, whether they are alive or dead, to pay back what wouldn't have been a taxpayer burden had the person had access to that money. It's a screwy system, but that's how it works.

A. The association will simply bill you for the payments. They will also eventually sue you in court to try to collect whatever payments you owe. As some other answerers stated, the association can place a lien on your condo, and foreclose. In reality, the association will not do that. If you are already behind on your mortgage, then that means your mortgage is more than the value of your property. If the association forecloses, then the proceeds will first be used to pay the balance of the mortgage. That will leave the association with nothing. The association is not going to go through the time and expense of foreclosing if it is not going to recover anything. A. Yes, this is a court date. And they mean it. Your answer is your legal argument for not paying them. You better have a good one too, otherwise they will win this. Include references to the actual laws you think justify your behavior. You really need an attorney though, they will have theirs. Otherwise just pay the freaking bill. They will not make up a payment plan, they already know how you handle payment plans, this is what got you here in the first place.
