Down payment in purchasing a home association to finishing basement and attic?
Q. In the process of purchasing a home, specifically a new construction, is it standard for the builder/seller to use the money from the down payment for certain requests made by the buyer (such as finishing the basement and attic)? Isn't it possible that the builder may finish the house, yet fail an insepection, and yet the builder already spent the down payment, therefore making it very difficult to retrieve the down payment?

A. down payment is only to open Escrow. You should of already negotiated the price and condition of transfer. You should also make the purchase contingent upon a home inspection, final walk through etc.. Seems like you can get a better price if you buy the property as is and finish it yourself.

Your governing documents will allow them to charge late fees and interest, deny you the use of the common areas, and charge you attorney's fees for the costs of collections. Some states have Contract Lien Acts, which allow the HOA to give you a 30 day notice to pay up or sue them. If you don't pay or sue in 30 days, they can place a lien on your property without going to court. Once they have a lien, they can foreclose. To make matters worse (sorry!) there is a rule the courts use called the Doctrine of Independent Covenants. Is it legal for a company to charge extra for not returning a payment coupon to them with your check?
Q. I pay my homeowner's association dues with an electronic bill paying service rather than send a check with the payment coupon. A. It may depend on the state you live in. In general, I would say that this is legal, however it is not very good business. It shouldn't take any time to find your account if they have the proper technology. It seems like the company is trying to squeeze your association for all they are worth. Why are some disabilities "trendy" and more deserving of support than others?

I was really upset to see a news interview this week with a man who has AIDS, who admited he got it from using IV drugs, saying he receives assistance for his mortgage payment, he takes taxis everywhere that are paid for, that he doesnt have to do without anything. The AIDS association pays for his internet, bought him a computer, pays someone to do his housework, his yardwork, etc. He is also completely mobile, not yet incapacitated by AIDS. This really angers me, WHERE is this same support for people with MS, ALS, Post Polio, and other disabilities that are debilitating? No one is paying mortgages for these other disabled people, or for taxis etc. And their disabilitiy is not the result of a life style choice. WHY does our society… [cont.]

A. You are absolutely correct. The same would hold true if the person were deaf or blind. No help available, even if needed. I suppose, Isotope, that you can count your blessings that you still have your wits about you and that you are able to manage despite health problems. I was really upset to see a news interview this week with a man who has AIDS, who admited he got it from using IV drugs, saying he receives assistance for his mortgage payment, he takes taxis everywhere that are paid for, that he doesnt have to do without anything. The AIDS association pays for his internet, bought him a computer, pays someone to do his housework, his yardwork, etc. He is also completely mobile, not yet incapacitated by AIDS. This really angers me, WHERE is this same support for people with MS, ALS, Post Polio, and other disabilities that are debilitating? No one is paying mortgages for these other disabled people, or for taxis etc. And their disabilitiy is not the result of a life style choice. WHY does our society… [cont.]

A. You are absolutely correct. The same would hold true if the person were deaf or blind. No help available, even if needed. I suppose, Isotope, that you can count your blessings that you still have your wits about you and that you are able to manage despite health problems. I suspect it's because AIDS has become a celebrity cause, and with the celebrity worship that goes on in this country, if a star says it's worthwhile, then, by God, it's worthwhile. Still, it doesn't seem quite fair, does it?

I live in condo in Southwest florida and I pay a monthly bill to an association?
Q. This company is slow to do anything. There are some repairs to be made and I emailed them to do this with no response. What would happen if I stopped paying my association fee each month? vWhat could they do because I havent seen anything out of my payment so far. Im an owner of about 2 years

A. After a couple of missed payments, you will get a notice that they are going to file a lien against your condo. The next step is foreclosure, then you won't have to worry about the HOA anymore. The best thing to do is run for the association board. You will then be involved with the decisions made for the complex. If you are a renter, not an owner, you need to keep the owner informed of the problems. The owner wants to protect his investment, and the board is more likely to listen to an owner than a renter.
